1. Who you are contracting with

The Everlasting service ("Service") is provided by Beautiful Grace Prints ("we", "us", "our"). By creating an account or using the Service you agree to these Terms & Conditions.

2. Acceptance

Your continued access to or use of the Service constitutes acceptance of these terms and any updates we publish. If you do not agree, do not use the Service.

3. The Service

Everlasting helps users draft obituaries using AI-assisted text generation. Output may be inaccurate or incomplete; you are responsible for reviewing, editing, and verifying anything you share or publish.

4. Acceptable use

You agree not to:

• Use the Service unlawfully, fraudulently, or for spam.
• Infringe intellectual property, privacy, or publicity rights of any person.
• Attempt to probe, scan, scrape, reverse engineer, or interfere with the Service or its security.
• Upload malware or use the Service to generate content that is illegal, harassing, hateful, or deceptive.
• Generate obituaries or biographical content about real people without appropriate authority or consent.

5. Accounts

You must provide accurate account information, keep it up to date, and safeguard your credentials. You are responsible for activity under your account.

6. Intellectual property

We retain all rights, title, and interest in the Service, including its software, branding, and documentation. You are granted a limited, non-exclusive, non-transferable right to use the Service on the plan you have purchased.

7. User content and AI output

You retain rights to information you provide. You grant us a limited license to host and process that content solely to operate the Service. You are responsible for how you use AI-generated output and for verifying its accuracy before publication or distribution.

8. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Refund handling is described in our Refund Policy.

9. Plan changes

Plans are one-time purchases. If you have purchased Premium and later purchase Pro, you may upgrade by paying the difference. We do not otherwise support plan changes or partial refunds outside our Refund Policy.

10. Service level and warranties

The Service is provided "as is" and "as available". We do not guarantee that the Service will be uninterrupted, error-free, or produce specific results. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability that cannot be limited by law.

12. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time.

13. Changes to the Service or terms

We may modify the Service or these terms from time to time. Material changes will be indicated by updating the "Last updated" date above.

14. Governing law

These terms are governed by the laws of the jurisdiction in which Beautiful Grace Prints is established, without regard to conflict-of-laws principles.
